The following is a general list of requirements if you are about to establish a business in Monaco:

    1. Obtain preliminary authorisation from Monaco authorities to create a business in the country that is deemed to be productive or supportive of the national economic future and sustainability;
    2. Justify sufficient financial funds to support yourself and your family during the initial period of Monaco residence;
    3. Present proof of accommodation in Monaco (long term lease agreement or purchase agreement in Monaco).

There are five (5) types of businesses you can set up in Monaco in order to qualify for the immigration program for entrepreneurs:

    1. SARL (société à responsabilité limitée), a limited liability company: minimum share capital of EUR 15,000, must have at least 2 partners and carry out commercial activities;
    2. SNC (société en nom collectif), a collective company: must have at least 2 partners, carry out commercial activities and every partner must be able to participate in trading;
    3. SCS (société en commandite simple), with both active and limited members: must have a least 1 active partner and a minimum of 1 limited partner;
    4. SAM (Société Anonyme Monégasque): minimum share capital of EUR 150,000, no trading activities required;
    5. Sole trader: you are the only active member of the company.

Every business may require different kind of sets of documents. However, regardless of the business you wish to establish, these common documents have to be provided to the relevant authorities:

    1. The completed form of “Application for permit to carry out a business activity in the Principality of Monaco”, which allows the officials to know your intent to create a business, the nature of the business and other relevant information that may potentially affect the outcome of other governmental bodies decisions;
    2. The “Personal Information” form, which would inform the Monaco government about your personal history;
    3. A civil-status document for each business partner that you wish to perform your business with in order to complete the relevant requirements for the satisfaction of the programme:
      i. A certificate of Monaco nationality or copy of his or her ID card in the country for Monaco citizen;
      ii. A photocopy of his or her residence permit for residents of Monaco;
      iii. A copy of the ID card or passport for foreigners who have not obtained Monaco citizenship not any Monaco residency;
    4. Birth certificate;
    5. Marriage certificate (and/or divorce certificate if applicable);
    6. A copy of the applicant’s criminal record, issued less than three months from the date of the application by relevant authorities in all regions that the applicant has resided for more than 1 year. This should be obtained from:
      i. The General Court Registry of Monaco for Monaco residents;
      ii. The national criminal records office for persons residing in France;
      iii. Local police offices of the country of origin for foreigners who are not residing in France at the time of the application;
    7. Proof of accommodation in Monaco;
    8. Proof of sufficient source of income to cover living expenses in Monaco;
    9. Motivation letter.

      v. Register with social security organisations so that all potential insurance and legality incidents relating to said insurances do not arise without significantly damaging your economic prospects
    9. MONACO: TAXATION

The lack of income tax dates back to an Ordinance by Prince Charles III in 1869. Taxation in Monaco is one of the benefits available to investors and wealthy individuals all over the world. In Monaco there is no wealth tax, annual property tax and council tax.

Monegasque nationals and foreign residents in the Principality (except French citizens) are not liable for income tax.

Tax on inheritance and gifts applies to assets that are located in the Principality of Monaco, regardless of the domicile, residence or nationality of the deceased person or donor.

The rate of taxation is 33.33 %, while capital gains from asset sales as part of business activities may, under certain conditions, be exempt if they are re-invested in the firm.

Firms created in the Principality and falling within the scope of corporate income tax that carry on a genuinely new business are exempt from tax for a period of two years and subsequently benefit from a favorable regime for the three following years, namely:

    1. 1st and 2nd year: no corporate income tax,
    2. 3rd year: the tax is calculated on 25 % of profit,
    3. 4th year: the tax is calculated on 50 % of profit,
    4. 5th year: the tax is calculated on 75 % of profit,
    5. 6th year: the tax is calculated on 100 % of profit.

MONACO: TAXATION

The lack of income tax dates back to an Ordinance by Prince Charles III in 1869. Taxation in Monaco is one of the benefits available to investors and wealthy individuals all over the world. In Monaco there is no wealth tax, annual property tax and council tax.

Monegasque nationals and foreign residents in the Principality (except French citizens) are not liable for income tax.

Tax on inheritance and gifts applies to assets that are located in the Principality of Monaco, regardless of the domicile, residence or nationality of the deceased person or donor.

The rate of taxation is 33.33 %, while capital gains from asset sales as part of business activities may, under certain conditions, be exempt if they are re-invested in the firm.

Firms created in the Principality and falling within the scope of corporate income tax that carry on a genuinely new business are exempt from tax for a period of two years and subsequently benefit from a favorable regime for the three following years, namely:

      1. 1st and 2nd year: no corporate income tax,
      2. 3rd year: the tax is calculated on 25 % of profit,
      3. 4th year: the tax is calculated on 50 % of profit,
      4. 5th year: the tax is calculated on 75 % of profit,
      5. 6th year: the tax is calculated on 100 % of profit.
